Murder

Murder/homicide is the most serious of charges and can subject a person to state prison for life, or the death penalty.  Usually codified in the Penal Code unedr section 187 there are many different special circumstances, stautory enhancements, and underlying charges that can be alleged.  A case with serious charges like murder needs to be handeled effciently and with care.  Time is a resource that cannot be wasted because the prosecution is working around the clock to get all the evidence to secure a conviction.

Some murders can also be classified as grossly neglignet murders.  For example, vehicular manslaughter and invluntary mansluaghter cases.   Vehicular manslaughter charges are codified under Penal Code Sections 191 and 192.  Many variations exist allowing the prosecutor to tailer charges to fit with the factual scenario  leading to the death.  Alcohol, drugs, and extreme negligence in driving can all lead to charges that can result in the DMV revoking your driving privilege and in a state prison commitment.

Assault & Battery

An assault as an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another and a battery is any willful and unlawful use of force or violence upon the person of another.

 Penal Code §§ 240-248 codify the majority of criminal charges for assault and battery.   Prosecutors have discretion to charge Assault and Battery crimes as either Felonies or Misdemeanors .  Sentencing for such a charges can include up to 5 years of probation, jail or prison time, anger management classes, counseling, fines, community service, restraining orders, restitution, and bans from owning or possessing firearms.
